10 DAYS UNTIL AYN'S 10TH BIRTHDAY


What a marvelous smile Ayn has
Within ten days, the world will celebrate Ayn Van Dyk’s TENTH birthday. I did say the world. International friends and advocates from numerous continents and countries and climates will be honouring Ayn with customized birthday merriment. There will be balloons and music and decorations and cake and candles and videos and website and blog entries and letters and cards with thousands of congratulatory expressions.

That’s right! The Facebook page called Help Bring little Autistic girl back to her daddy contains the moment by  moment interactions of almost 5000 people whose heart has responded to the injustice meted out to this little girl when she was nine years old. It was on June 16th 2011 that the Ministry of Children and Family Development in B.C. took her from her school and then informed her father Derek that they had her in their custody. That was to be viewed as in her best interests and brazenly Derek was to consider this the Ministry’s proactive step to relieve him of burden because he was seen as overwhelmed. 

And this preposterous conclusion was result of a more than standard walk away by Ayn on the 12th of June. She climbed over a high fence and was gone from her yard for three hours. Autistic children do this. They wander off. Do you understand how a parent might not have his or her eyes glued to a child who is contained safely in a fenced back garden? Her brief trip could have been addressed by constructive follow-up with Derek, and for no reason whatsoever, did Ayn need to be taken from her safe and loving home. Worse than even the separation her physical welfare has been invaded by a plethora of antipsychotic drugs over these months. So now, she arrives at her birthday month and she is not at home. By the time of her birthday it will be six months, one half of a year, 180 days that she has been prevented from returning to her family home.

People all over the world understand that this represents injustice, grievance, infringement and unfairness.

This band of 5000 is requesting that the Ministry of Children and Family Development return Ayn to her family in time for her December 14th TENTH BIRTHDAY.

  5. Ron: am I correct in understanding that there has not yet been a presentation hearing on the Ayn Hoare case? If there has been no presentation hearing, does this mean that there has been no presentation report and that there has been no statement by the ministry of the grounds for removal?
    Has Derek got a lawyer and has the lawyer been given any information. Have any court dates been set at all? Basically I am concerned that the law has been ignored and the lawyer is unable to persuade the court to heed the basic requirements of the act. I am especially concerned as to the time lines which you know so well. Presentation hearings summary and must be completed as quickly as possible with basic disclosure of the ministry's case. Protection hearing within 45 days with ten days clear written notice to both parents stating the order sought. Full disclosure must be made in time for the hearing. Basically the intention of the act is to give the parents the opportunity to test the evidence within about two months from removal of child.
    Oh and has Mr. Hoare himself written to the director, Mr. Stephen Brown and has he had a reply? I will write more when I have the answer to some of these questions.
