LAWYERS

Since the enactment of the Child, Family and Community Services Act the use of lawyers has dramatically increased. Now that proper training in the act has become uncommon, the social workers rely on legal advice for every function.


Interviews with clients have become so adversarial that they are often conducted with counsel present. This intimidates clients to the point where they feel they too must have an advocate present. It should be obvious that the legal profession and the courts have a very old tradition of being adversarial. It is also well known that the more adversarial the culture, the more financial benefit goes to lawyers, so they have little incentive to negotiate.

Justice is the Fabric of a Healthy Society

When a society such as ours creates a system to punish wrong doers, to defend innocents, to correct mistakes and to restore liberties, we expect that justice will be delivered. When within a society a ministry dedicated to children and families is empowered, we expect that it will protect the vulnerable, accurately assess people, and repair broken situations.

Love is the thread .Woven from billions of such threads, justice is the resultant strong and integrated fabric. The fabric is known by the name of integrity and it can be fashioned into a garment prepared for residents of earth. It is the fabric of a healthy society.  

Injustice occurs when countless numbers of these threads are pulled from the garment. As the holes enlarge, the wearer of the garment is uncovered and vulnerable.

A work of justice becomes essential to mend the rips and tears that have occurred in the fabric of a society and its governance. The repair consists of the replacement of frayed threads. That work must begin again with love.

LOVE IS A THREAD

Justice is a garment prepared for residents of earth. It is woven from billions of threads, knit together into a strong and integrated fabric. Love is the thread and it has produced a fabric of integrity.
Injustice occurs when countless numbers of these threads are pulled from the garment. The wearer of the garment is uncovered and vulnerable.
The work of justice is to mend the rips and tears of injustice that have occurred in the fabric of a society and its governance. The repair consists of the replacement of frayed threads, so the work must begin with love. 

The idea for my literary fragment above was inspired by THE JUSTICE CONFERENCE that uses among its images this one. Love is a Thread. This Conference promotes dialogue around
justice related issues such as human trafficking, slavery, poverty, HIV/AIDS and human rights.

Ayn Van Dyk’s release from government care into the waiting arms of her father Derek Hoare is at the very least the requisite solution to a human rights issue. It may be much more upon closer scrutiny of the policy, interpretation and practices that make it possible for a protection agency in response to a notification of a child missing for three hours, to take that child from her family. When due consideration is given to the child’s autism, not a father’s negligence, that accounts for her nomadic excursion to a neighbour’s yard, the shredding and slashing of justice is readily apparent. Immediately following Ayn’s brief trip, protection social workers appeared with a voluntary release form for Derek to sign. That was met by his anxious and incensed refusal. Four days later, unannounced, this government agency removed Ayn from her public school classroom. Ayn’s justice garment was in tatters as was Derek’s and his sons, and the extended family’s garments. Love covered her at home in the prettiest material designed specially for her. Only love’s thread can mend the lacerations so she is properly adorned again. Over 4000 people are members of Ayn's Facebook page, called 'Help Bring Little Autistic Girl Back to Daddy." and many are actively involved in lobbying for her release. Our comments are shared all days long. Here we weave our voice and our gifts into the project of Ayn’s protection so she can wear her garment of justice with its irreplaceable threads.

TERMS OF JUSTICE / Part 335 / For Love and For Justice / Zabeth and Paul Bayne

Given our Canadian Rights and Freedoms, a miscarriage of justice within our Canadian legal and social context is essentially the conviction and punishment of a person for a crime that he/she did not commit. Synonymous with miscarriage of justice is the term 'wrongful conviction' which refers to conviction reached in an unfair and disputed trial. Occasionally the biased term 'travesty of justice' is applied to an offensive and deliberate miscarriage of justice

There are avenues by which to quash or overturn a wrongful conviction but these are difficult to navigate and achieve. We all agree that the most grievous cases are wrongful convictions that are not overturned for many years or before the convicted but innocent person dies by execution or natural death while incarcerated.

But here we are discussing not a criminal but a civil matter, a child protection issue, where the suspicion card is played as strategically and effectively as the evidence card. The suspicion card is an incredible card because it permits the player to proceed directly to the goal without passing GO and yet collects thousands of dollars en route. That's what has happened to date. Now however, the court case required the player to present the suspicion so convincingly that suspicion should be regarded as equivalent to evidence. Circumstantial is to be regarded as actual. What a leap! What an hypothesis! What fertile ground for ---------MISCARRIAGE OF JUSTICE.

In the case of the Baynes what we have is not a conviction at all because there have been no legal criminal charges brought against the Baynes. So, no, they have not been wrongfully convicted. Yet a penalty has been imposed already, not only upon a mom and dad who are suspected by the Ministry of Children of harming their youngest child, but also upon the three children whom we all would concur are truly innocent. October 22nd is quickly approaching, the date that marks the removal of the children in 2007. This family has been enduring this penalty, surviving somehow, for the past almost three years.

How Mss. Polak and Dutoit cannot be concerned, or troubled, perhaps appalled, intelligibly sickened by the injustice of this aspect of their Ministry operations I fail to understand. At least be attentive to it. Forget that this case has been before the court since January. There was ample time before the actual court date for a top level intervention, some kind of compassionate involvement to second-guess and inquire into the case handling by the Fraser Valley Region of the Provincial MCFD mandate.

Let's suppose that the Judge's ruling does not move in favour of the Baynes. The children remain in provincial foster care. Let's suppose it proceeds beyond that to the adoption of the children.

Years in care can have a substantial, irreversible effect on the maturing child becoming an adolescent and an adult. In a case such as the Baynes, a CCO (Continuing Care Order) with its potential for adopting the child to new adoptive parents, the child will never have cause to believe that one or more parent did not abuse her when she was an infant. Their reputations will never have been officially untarnished. She may want nothing to do with her birth parents when she is of age to find them. Her sibling brothers may or may not be adopted with her. The sibling relationship will be effectively severed. And the boys if they remain together may always wonder why the parents with whom they could not live for three years but who visited them faithfully during those three years dropped out of sight and didn't visit any longer. And Paul and Zabeth, fifteen and twenty years from now will be moving out of middle age with hearts wounded irreparably and with lives scarred deeply because the children who were their life, have never been a part of it. 

Judge Crabtree must decide against the Continuing Care Order, forget the Last Chance Order/Temporary Care Order, or any other option that credits the MCFD with any credibility whatsoever. Allow the children to return to their parents. It is the right thing to do. It is IN THE BEST INTERESTS OF THE CHILDREN!

WHAT IS THIS DESTRUCTIVE PHENOMENON? / Part 178 / For Love and For Justice / Zabeth and Paul Bayne/

Ever since I became interested in the Paul and Zabeth Bayne family retrieval, I have been exposed to a phenomenon which I am seeking to understand. The phenomenon is noticeable in the stories people tell me about their experience with the Ministry of Children and Family Development. I personally feel a rising level of the phenomenon myself as I read the history of disappointment with and attempts to revise the MCFD through the years.

I have tried to identify this phenomenon with an appropriate word or a tag. Cynicism and skepticism come to mind. Either one may be suitable but not exact. Cynicism with regard to MCFD is the belief that only selfishness motivates the actions and decisions of those involved in the Ministry and of the wider government that authorizes them. Skepticism maintains doubt about the statements, the promises, the agreements, the plans of MCFD employees and questions the validity of anything the MCFD purports to be factual. Another close kin word may be pessimism. Pessimism is an inclination to emphasize adverse aspects, attitudes, intentions, and outcomes of MCFD involvement. That is not exact enough either.

I believe the proper term is 'distrust.' If the other three terms are disheartening, when associated with a Ministry that we all fund for our mutual benefit, the application of the term 'distrust' to the Ministry with the power to alter lives is demoralizing. Yet 'distrust' is what I hear from people.

Distrust is the confident expectation that Ministry employees' motives, intentions, policies and behaviors are sinister and harmful to one's own interests. That's what I hear from people. This may often entail a sense of fear and anticipation of discomfort or danger. Distrust naturally prompts us to take steps that reduce our vulnerability in an attempt to protect our interests. Distrust is not the exclusive domain of parents who feel wronged. Distrust is experienced by Ministry people toward some parents and supporters as well. Distrust possesses a destructive potential. Up go the adversarial, competitive walls. Cooperation gets lost. Conflict is exacerbated.

Once distrust has been established, it frames subsequent events in the relationship so that even good-faith efforts by the opposing party in the relationship are met with disbelief and suspicion. The result is a "self-fulfilling prophecy," where every move the other person makes is interpreted as additional evidence that justifies an initial decision to distrust him/her. This distrust not only inhibits cooperation in the relationship, but also may result in retaliation that causes the conflict to escalate. When the other person reciprocates this sentiment, there is mutual distrust that further fuels the escalation of conflict.

I cannot express how dismayed I am with the behaviour of Fraser Region Ministry case management. Paul and Zabeth Bayne are not villainous but are wounded parents whose innocence of responsibility for their daughter's injuries has been met with the Ministry's unrelenting insistence on their culpability. When supporters spontaneously appear to encourage their friends at court, the Ministry assumes the Baynes have invited them. When the Baynes request more visitation time with their children in a park setting or at a pre school or kindergarten event, the Ministry assumes there is another agenda behind the request. Folks, these are people who want to be with their children. Time is marching on. The Fraser Region and the Ministry office in Victoria need to give their heads a shake. Of course there is publicity around this case. Publicity is the only instrument helpless parents have in response to a Ministry with absolute power. Ministry! Consider the obligation you have to make this family work again. But then ….oh well, that distrust is kicking in again.

FACING THE LAST GOODBYE / Part 142 / For Love and For Justice / Zabeth and Paul Bayne/

THE FINAL GOODBYE WITH LIVING CHILDREN

I asked Zabeth how she and Paul were doing. She wrote to tell me and her sentiment touched me. With her permission I print it for you to read. A qualifier first: I have mentioned before that Paul and Zabeth have faith in a sovereign God and this faith relationship is important to them. It is evident in the way she deals with her feelings.

“How are we today? We have had a hard last few days. While we have been sick we are doing better in that area, but I have been feeling low emotionally. I miss my children daily, but sometimes when I realize the trial will be coming to an end eventually I start to fear that a decision will be made to permanently separate me from my children forever. How does a parent live through the final goodbye visit? If one was guilty then one could understand and feel the ruling was deserved and if one truly loved the children one might acknowledge that it would be better for the children, but when it is a wrong decision, when love is genuine and no harm done...Will God expect this of us? Would this bring Him Glory by sacrificing our children in order for us to take up a call of helping others and thereby bringing Glory to Him in the answers to prayers of other parents? Or will bringing our children home bring Him Glory? What is His will for our lives? Will we see earthly justice? I pray so, but these are some of the questions I fear to answer.”

Just imagine parents having to wrestle through possibilities like that simply to come to terms with an inconceivable outcome.

The options as Zabeth reviewed them were these. Perhaps in the permanent forfeiture of their children, God has a purpose to accomplish a glorious ending in some undisclosed way. Although she ventures down that dark road far enough to conjecture whether childless, she and Paul might be expected by God to be able to help other people with damaged lives. Or perhaps in returning their children to them, God will be glorified in this family, in their story of tenacity and faith, and their nurturing of these children into adulthood so that each walks an upright life or accomplishes something remarkable.

What is his will for us? Will justice be done? I pray so, but these are some of the questions I fear to answer, she wrote.” What an honest response this was to my “how are you doing?” query. The legal and judicial sides not withstanding, this is the human side of this sad and in some ways merciless mess.

For Love and For Justice / Part 92 / Zabeth and Paul Bayne

Life is too precious.

My own life is almost spent. Sure I may have many years to live. Yet my energetic working years are done. The strong blond man of my high school and college years lives only in pictures seldom viewed by anyone. My children now in their own mid years don’t remember me in my youth. In their minds they have only grown accustomed to the ‘me’ with escalating limitations. Their children will always know me ‘old.’ Grandpa I am.

I am not complaining. This is life. It’s good. There are large measures of joy and satisfaction attached to this personal definition of life in Canada.

That’s why the wounded lives of Paul and Zabeth Bayne and their children Kent, Baden and Bethany trouble me so much. That's why the Court Case, the result of which will determine whether the children can come back to their parents or whether they must be forced to become adopted children to adoptive parents, is one of the most important events in B.C. right now. It is only one family of course. However, this single case forecasts the likelihood of an overhaul of the structure, protocol, personnel and policies of this beleaguered child protection agency. It is unthinkable that the Judge's conclusion might greenlight further injustices to more innocent parents and children as zeal and power without wisdom decides the lives of citizens.

The Baynes should not be enduring this broken family unit, the financial ruin, the daily tears, the eyes of three children filled with worry and doubt about so many things that should not harass a child in Canada.

Justice needs to be served on a silver platter to this family so that what remains of three children’s formative years will be spent in the affectionate and daily embrace of parents who love them so tenaciously that they will plead ardently until the custody of their children is restored to them. They will also unceasingly declare their innocence. Innocent, they will never admit to a guilt that is implied by a two year old medical diagnosis of baby Bethany with which a long list of medical professionals dispute. This court case, painfully lengthy, will validate the Baynes as worthy parents who have suffered an incalculably horrific two and a half year travesty of human rights, freedom and justice.

Zabeth and Paul Bayne – Part 56 – The Bayne Campaign for Justice


A QUESTION OF INEQUITY

Paul and Zabeth have been informed in the past that when they visit their three children on the two afternoons each week, they are not to speak to their children about the past. That’s correct. They are not permitted to talk about what it was like to be a family two years ago. They are not to remind them of home as it was before the Ministry of Children stepped into their lives in October 2007 and removed the children from all that was familiar. These two little boys have been in four foster homes in two years, yet Paul and Zabeth are not permitted to speak hope to them about the possibility of coming home to be a family again. A supervisor sits in all these family gatherings and listens, even making notes of what is observed and heard. Paul and Zabeth must be in compliance or visiting rights may be removed completely, because these children now belong to the province of British Columbia under an interim court order. Interim lasts a long time - over two years apparently!

But then, please note this inequity! The other afternoon while Zabeth and Paul visited their boys, one of them told mommy and daddy that the caregiver has told him that if the Judge rules that she can keep the children, then she promises to put them in swimming lessons. Would you consider that to be talking about the future and seeking to engender hope for a certain future outcome? I would. So apparently the same conversational restrictions are not applicable to the temporary care giver. It’s challenging for me to envision a foster caregiver wanting to kindle in a child an expectation for a result that terminates an existing family completely. This child has been told that he will be with the caregiver for a long time. How much more constructive would it be for a foster parent working for the province’s child protection and family development agency to be on assignment to encourage that child to believe that his family will come together again because that is what ‘we all want.’ ‘We’ should pertain to every member of this MCFD enterprise. ‘Restoration’ seems not to belong in the vocabulary of the MCFD officials who have managed the Bayne portfolio. On this same afternoon Paul and Zabeth were reminded that they are not allowed to speak to their children alone or out of the hearing range of a supervisor. No private conversations are permitted.

The regional MCFD should be all over this to insure the integrity of the Ministry’s mandate is not compromised. The regional MCFD office that manages the Bayne case is the Fraser Region. It will be interesting to learn whether this is acceptable MCFD practice or whether the Victoria MCFD front office conscience alarm goes off when they learn of this.

Zabeth and Paul Bayne – Part 52 – The Bayne Campaign for Justice

I can’t stand it.
The Bayne family of five should be together permanently. They should be together for Christmas. It should one of the innumerable family sleepovers until those three children are responsible adult children.

This is not merely an emotional response for me. This is a deeply felt sense of what is right. I am horrified by the perceived if not real callousness of some public servants involved with this case.

Understand this please. I believe that with sincere professionalism, a medical practitioner made an informed diagnosis about Bethany’s condition and the cause. I surmise that this doctor may no longer be convinced it was the right call, particularly when the Baynes can call a medical expert for each of the twelve days of Christmas to contest the diagnosis as faulty.
Paul and Zabeth Bayne have borne an undeserved penalty far too long now – over two years without their children living in their home. They have endured the suspicion of a government ministry the power and authority of which is offloaded down so many layers of bureaucracy, the crown doesn’t know what the foot soldiers are doing. In stark contrast to the paper policies and media pronouncements of disclosure and openness, the decisions about the childhoods of three Canadian children remain concealed in a secrecy that is guised as protection of privacy. Those who have directly affected this injustice against an entire family rarely communicate with the parents; seldom provide the courtesy of an acknowledgement to correspondence. Officials higher up the agency chain refuse to comment because they can refuse. In order to protest their innocence, a Canadian couple can be compelled by this fat citizen funded system to forfeit all economic collateral in order to hire legal representation. They have.

Nothing specific or verifiable in Paul’s and Zabeth’s personal or family history supports prolonged suspicion. There is no incontestable evidence that either parent injured their baby daughter. Police abandoned that investigation hours after it was first reasonably conducted. The Ministry’s own lawyer has informed the Ministry many months ago that the two boys should certainly be returned to the parents because there is no defensible ground to keep them. This is a ministry that affirms that one of its principal objectives is to restore custody of children to parents.
Paul and Zabeth are fit parents. They have demonstrated this valiantly under the most trying circumstances, with just a few hours of visitation privilege each week, and with understandable calls and letters regarding their children’s health and well being when they flag concerns that are missed within the foster parenting program or ignored by MCFD that do not want to fund further medical examination. All three children should be returned to Zabeth and Paul.

Zabeth and Paul Bayne – Part 49 – The Bayne Campaign for Justice

“The Ministry of Children and Family Development is holding the children for too long for no legitimate reason. Holding the children this long is in violation of the law. The law stipulates that the TOTAL PERIOD for a child under 5 in the temporary custody of “MCFD” MUST NOT EXCEED 12 months. (S.45(1)(a) of the Child, Family and Community Service Act).”

That is what one of the signers wrote. It is reflective of so many for whom the action of the MCFD in keeping children away from two good parents for two years is reprehensible. Here are some comments from other people.


“I have 2 friends who are going through this very thing, and BOTH cases of suspected SBS were right after the child received immunizations. I think Hep B. Something to look into. Dr Yazbek does studies on this.”

Child abuse is a serious thing...but jumping to conclusions seems to be commonplace. “What has always appalled me about this case is the blatant disregard that individuals in the BC Ministry of Children have for the laws which govern their own behaviour within that Ministry. Further, the lack of action on the part of the elected officials who have learned of this disregard is very disappointing. If we do not stand with others through their trials of injustice, who will stand with us when they knock on our doors?”

With the idea to protect the children the system is against the principal international core of law which is everyone is innocent till proven guilty. With MCFD you are guilty until proven innocent.”

First a Summary: Paul and Zabeth Bayne’s three children have been in the custody of the B.C. Ministry of Children and Family Development for two years. The Baynes visit their children twice weekly. Every possible avenue of appeal has been tried by the Baynes. Their story has been aired on Global and CBC television. A court date must yet be set. They have a competent lawyer to represent them but many of us believe MCFD can and will return the children before Christmas 2009.

Zabeth and Paul Bayne – Part 43 – The Bayne Campaign for Justice

Life is too precious.

My own life is almost spent. Sure I may have many years to live. Yet my energetic working years are done. The strong blond man of my high school and college years lives only in pictures seldom viewed by anyone. My children now in their own mid years don’t remember me in my youth. In their minds they have only grown accustomed to the ‘me’ with escalating limitations. Their children will always know me ‘old.’ Grandpa I am.

I am not complaining. This is life. It’s good. There are large measures of joy and satisfaction attached to this personal definition of life in Canada.

That’s why the wounded lives of Paul and Zabeth Bayne and their children Kent, Baden and Bethany trouble me so much.

My life came this far without the incidence of anything disruptive either when I was a single man or during my married life. My children have grown through childhood and adolescence and into adulthood within the comforting environs of dependable harmony, supply and possibilities. Through all the years, for most of our family peer group this was normality. Do I think every family should have the same experience? It’s not reasonable. But I can tell you unequivocally that I don’t believe the Baynes should be enduring the broken family unit, the financial ruin, the daily tears, the eyes of three children filled with worry and doubt about so many things that should not harass a child in Canada.

Justice needs to be served on a silver platter to this family so that what remains of three children’s formative years will be spent in the affectionate and daily embrace of parents who love them so tenaciously that they will plead ardently until the custody of their children is restored to them. They will also unceasingly declare their innocence. They will never admit to a guilt that is implied by a two year old medical diagnosis of baby Bethany which has not be confirmed and which a long list of medical professionals dispute.

Zabeth and Paul Bayne – Part 41 – The Bayne Campaign for Justice


I shared the following thoughts recently with someone whom I respect and admire, who is multi-gifted, generous to a fault, intelligent and creative and driven and goal oriented and loves God.

Quite a special person you are thinking. I would agree. I wrote to him because he has large dreams and they often involve people and I felt people were disappointing him.

From Micah 6:8 the familiar sound of “He has told you, O man, what is good; and what does the LORD require of you but to do justice, and to love kindness, and to walk humbly with your God? The question mark at the end of the sentence in the English version suggests that the entire statement is the question rather than the last part being a statement. It’s a virtual “how did you miss this – you already know the answer.” So from my perspective, in light of the scathing indictment in the previous verses, directed at God’s people who seem to have lost sight of who God is and all that He has the capacity to accomplish, comes the only conclusion at which one can arrive when God is omni-everything. And what does the LORD require of you O man, surely not something outstanding and attention grabbing, but rather what you already know. Isn’t it to do justice, love kindness, and walk humbly with your God? Hint, hint!!! That is Micah’s emphatic question.

Essentially what I was saying is that each of us, while disappointed by others, is responsible to God for ourselves. I am very sure that the decisions that should return Paul’s and Zabeth’s children to them could be made this afternoon when the people who must make them are exercising justice, cherishing kindness and above all walking humbly with God. I also know that in our law oriented and litigious culture, the decision makers can, well almost predictably default to the court to make the decisions for them. That is disappointing. It preserves the tension between the parents and the caregiving protection agency for which we should be thankful. So Paul and Zabeth will have to wait for that court date. In the meantime, they themselves will have to do justice, love kindness and walk humbly with God. If you are someone who has found yourself sympathetic to the Baynes and what is to you convincingly an injustice then you are disappointed too for their sakes. Don’t forget what God expects of you, of us. This ministry has it on paper that it is interested in returning children to their parents, and this is one couple whose life demonstration emphatically demands that these three precious children be permitted to live happily ever after with their mom and dad who have never done anything but to love and to protect them from the moment of their births. So burn brightly everyone! Let your light shine!

Five Years Ago - The Hughes Inquiry into MCFD Performance

There were grave concerns about the management of the Ministry of Children and Family Development when in November 2005 a Panel was named to review B.C.’s Child Protection System.

A Vancouver Sun article of December 29, 2005 was titled ‘BC Foster Children at Risk.’ That piece mentioned that the beleaguered MCFD was undergoing a sweeping review by Judge Hughes following the recent deaths of two children in care and the mishandling of child death reviews. There was an alarming shortage of foster homes. MCFD was acquiring more children than it had foster parents and homes. The Liberal government had restructured MCFD and the number of foster homes was reduced further. To its credit the Liberal regime sought other alternatives like mediation to allow children to remain with parents or relatives or be adopted. Nevertheless, overcrowding in some foster homes resulted. While so many foster parents regard their roles as a responsible trust, it is not reckless to imagine that recruitment standards for foster parents became relaxed in face of the need. Hence the title of the Vancouver Sun article and the suggestion of risk to children in foster care.

The panel’s mandate was to independently examine B.C.’s system of oversight, public reporting and advocacy with respect to the protection of children and youth.
Panel members were:
• Ted Hughes Q.C. (Chair)
• Grand Chief Ed John, former B.C. Minister for Children and Families and former law professor
• Jane Morley Q.C., lawyer and mediator, Child and Youth Officer
• Terry Smith, Chief Coroner, served with the RCMP for 35 years
• Joyce Preston, former Child and Youth Advocate, former director of social planning for Vancouver
• Ms. Maureen Nicholls, former commissioner of the Public Service Employee Relations Commission
• Thomas Gove, a provincial court judge who was commissioner of the Gove Inquiry into Child Protection 10 years ago, was available to engage in discussions with the panel if requested to do so by the panel.

A compelling term of reference was the review of deaths of children. The panel reviewed the roles and responsibilities of the Ministry of Children and Family Development, the Child and Youth Officer, the Chief Coroner, the Ombudsman, the Public Guardian and Trustee as they related to advocacy for children and youth and to monitoring and public reporting on the government’s performance in protecting and providing services.
It is the public reporting that chiefly interests me. That honesty and sincerity is essential to increasing trust and reducing fear. It appears that another review is required. Perhaps Mary Polak can generate that internally. I am sure she will want to as she acquits her responsibility to the best of her ability.

Zabeth and Paul Bayne – Part 36 – The Bayne Campaign for Justice


Doug Christie is representing them and he stands for truth, freedom and justice.

He is not the conventional lawyer. He has a nation wide reputation. Mr. Doug Christie has come alongside this troubled couple when all their resources were consumed and they were left without legal representation in contesting for custody of their own three children. His involvement makes this story take on a new and hopeful dimension.

Mr. Christie has many critics, understandably because he has chosen to defend some of the most controversial defendants in Canadian history. Because he specializes in cases where the issues are freedom of speech and individual rights about which Christie is passionate, he has represented James Keegstra, Ernst Zundel, John Ross Taylor and Malcolm Ross before the Supreme Court of Canada, David Ahenakew before the Saskatchewan Court of Queen’s Bench and the Saskatchewan Court of Appeal, and Lady Jane Birdwood before the Queen’s Bench and the Court of Appeal in London, England. Mr. Christie also draws fire because respecting his personal liberty and his own right to free speech; he speaks against big government, and speaks for an independent western Canada and speaks against Ottawa deciding unsuitable immigration, two official languages, banking, international trade and unpatriotic foreign policy. Sure he sounds like a separatist. He views himself as a reformer for whom a new nation of Western Canada is the only option. His website Western Canada Concept details these views. He founded the Western Block Party in 2002.

This is one of many YouTube videos he produces and this one is called 'Overcoming Threats to Freedom' Once on that YouTube site, you will find a list of his online commentaries.

So why should the Baynes be comfortable with this renowned lawyer given the publicity he has garnered to himself? He has answered his critics with comments on his website. Here is a sample of the thinking that inspires hope that he will do his utmost to assist his clients.

“I know defending Dr. Ahenakew, Mr. Keegstra, Mr. Zundel and others has made me a target for my enemies. It is a lever to trick people into condemning me. But I reasoned that if I did not have the courage to defend the unpopular, free speech would die and Western Canada would be as corrupt and shallow as Canada has become.”

“I find bullies repulsive and gang violence most offensive. The one thing I find in common among the thousands of people I've defended in the past 35 years as a lawyer, was the fact they needed a defender because they were weak. I became their defender so they would not stand alone against the mob.”

In reference to the challenges he has faced he writes.
“After the many clients I have represented, I have been perceived as a right-wing extremist, Nazi, or anti-Semite. These smear words are inaccurate, unfair and obscure in their meaning. That's how smear words work. …I am an individualist. I assert my right to be measured as an individual and I recognize every other person's right to be so assessed, as well. “

“My major challenge is to have myself and my thoughts and words assessed on their individual merits, rather than being stereotyped, slandered and written-off as most people in the media have already done. I am not in fact as I am represented by my enemies. I am a complex person with an essentially altruistic, generous, intelligent nature, upon which is superimposed a genuine desire to be a follower and servant of Jesus Christ.” … “I seek to build a better world for my people (Western Canadians) and all mankind. My major challenge in brief is to be taken seriously after what has been said about me.”

“It has liberated me from fear of what others think. I know the truth and the truth knows me. I serve the God of Truth. The opinions of men are sadly and perpetually misinformed in this world and there is little or nothing I can do about it.”

So come what may, I will stand for truth, freedom and justice. These three are really one, combined like the Holy Trinity.

Zabeth and Paul Bayne – Part 35 – The Bayne Campaign for Justice

BETHANY
Bethany is a little older than two years of age. Bethany Bayne was born August 3, 2007. She was a few weeks old when she was removed from her mother’s and father’s home and she has not been back since then. She has been in the custody of the Ministry of Children and Family Development and in the care of foster parents within a childcare system that does not require all foster parents to be licensed or registered.

Bethany was born prematurely. At the time of the accident that her parents reported in late September 2007, Bethany’s tiny body was dealing with the rigors of this early introduction to the world. She was anemic at birth and had milk intolerance like her two brothers when they were born. Bethany’s slow progress was interrupted by a head trauma caused by the accidental tumble of her small brother as he came around a corner into the room in which Bethany was lying on a blanket on the floor. Zabeth witnessed this mishap. Of course the incident was alarming and Paul and Zabeth delivered CPR as they rushed her to emergency at Fraser Valley Hospital in Hope. At the hospital she was unable to breathe and unresponsive after vomiting and she was hooked to oxygen and monitors. The hospital was unequipped for infants so she was sent home after a one hour observation. Some hours later her parents returned her to Fraser Valley Hospital because she was not moving her limbs, was not feeding or crying. She was transferred to (MSA) Matsqui Sumas Abbotsford Hospital where an examination failed to find anything wrong with her and she was released next day. Three days later she was taken back to Fraser Valley Hospital because she was vomiting and not crying and she was diagnosed with constipation and released. She was still in trouble.

In early October Zabeth and Paul took their baby to Chilliwack Hospital where she was given a bowel x-ray which was inconclusive. She was transferred to MSC Hospital where from October 6th to the 9th her increased head circumference was noted and a CT scan considered but not done. Her monitors indicated breathing stoppage a couple of times. She was checked, stabilized and was sent home. Then on the 13th of October the Ministry of Children (MCFD) now instructed Zabeth and Paul together with their doctor to take all three children to the Apple Clinic. Of all things, a neighbour, concerned about the children’s physical sizes, had reported that the children were malnourished and neglected. Their family doctor later termed this citizen’s call as malicious. The stresses continued. Three days later mom and dad took Bethany to the Hope Clinic which then ordered a CT scan which was accomplished at Chilliwack Hospital. The scan results were sent to Sick Children’s and finally after all that had preceded, the scan results were reviewed by two doctors, one of whom delivered the life changing diagnosis.

This doctor was knowledgeable with Shaken Baby Syndrome Research. Shaken Baby Syndrome (SBS) is, in essence, a medical diagnosis based on the presence of a diagnostic triad: retinal bleeding, bleeding in the protective layer of the brain, and brain swelling. Bethany had all three. She was a sick baby girl. A well informed doctor when faced with an injured child with no evidence of physical abuse other than the triad of SBS symptoms will consider it his/her duty to be cautious for the sake of both the child and the parents. This respected physician diagnosed Bethany as, what else, a Shaken Baby. A Shaken Baby has to have a Shaker, and who would be the most likely Shaker? One or both of the parents.

The consequence was the removal of all three children from the Bayne home, a harrowing arrest of Paul and Zabeth, resultant charges of aggravated assault on both of them; the unpleasant interrogations that insinuated that they, loving parents of two little sons, chose to maliciously shake up a baby daughter who was two months old. No wonder Zabeth went into alarming shock and a brief hospitalization.

What was learned only later was that Bethany had osteopenia of prematurity. Osteopenia is a decrease in the amount of calcium and phosphorus in the bone. This can cause bones to be weak and brittle, and increases the risk for broken bones. While in the womb, fetal activity increases during the last 3 months of pregnancy. This activity is thought to be important for bone development. During the last 3 months of pregnancy, large amounts of calcium and phosphorus are transferred from the mother to the baby so that the baby's bones will grow. A premature infant may not receive the proper amount of calcium and phosphorus needed to form strong bones. Most very premature infants have limited physical activity, which may also contribute to weak bones. There may be an increased risk for fractures throughout the first year of life for very premature infants with osteopenia of prematurity. As for prognosis, fractures will usually heal well on their own with gentle handling, and increased dietary intakes of calcium, phosphorus, and vitamin D. However, Bethany was also lactose intolerant (couldn’t digest milk product) and therefore lacking in vitamin D. Lactose intolerance is sometimes seen in premature babies whereas children who are born at full term generally do not show signs of lactose intolerance until they are at least 3 years old.

Today Bethany is doing well. The shunt was removed several months ago. Her vision which was an earlier concern is normal according to a disclosure report. Perhaps due to her premature birth she is developmentally average. At her age she is using a fork and spoon and cup. She is understanding of most conversation but her speech is below average and includes only a few words like “Daddy” “Mommy” “doggy” “milk” “cookie” “amen” “bumpa” for Grandpa and “Gammy” for Grandma.

Finally after two years Bethany is with her two brothers. Bethany was moved recently into the same care home as her two brothers Kent and Baden. That's a good thing relationally. She knows them because of occasional family visits together but it is uncertain that she understands that they are family.

Zabeth and Paul Bayne – Part 34 – The Bayne Campaign for Justice


I interact via email each day with Zabeth and Paul. On Monday I wrote to her and didn't hear back until evening. I was gripped by what she wrote to me privately and asked for her permission to share these thoughts. This is what it feels like to be them.

"We didn't get to see our children on Sunday, but did see them today from 1:00 until 4:00. We are emotionally drained before and afterwards as it is so traumatic for all of us to meet under supervision and then have no choice but "walk away". Our children don't understand and we shudder to think of the possible damage to them emotionally with their stability, security and the feelings of being wanted by their parents. It is barbaric to continually withhold a family's God ordained privilege to be together.

All of our hearts weep silently during the visit as we all try to relish the moments we have together. After we leave, the tears freely flow as they are now when I write. It is helpful to share with you, as you understand the joy we had when we had our children with us and how we treasured every moment. We kept daily diaries on our little ones and what may have seemed unremarkable to an observer was a miracle to us as they grew. Now after hearing our story and reading what is in our hearts, I know you understand a little of the pain that is embedded in our hearts, but not without hope.

Like Abraham laid Isaac on the altar we have had to lay our children before our Lord to protect and care for and as we do we anticipate His intervening hand to walk all of us down that mountain again."


Zabeth's reference to Abraham and his son Isaac is an allusion to the sacrifice God called Abraham to make as he tested Abraham's faith. The story is a classic, because Abraham's obedient faith empowers him to do the unthinkable, offer his own son as an actual sacrifice in Old Testament style. It's horrific in the extreme. It's unimaginable. It's a poignant story because Isaac is the offspring from whom God's promises to Abraham concerning a family and a future should come. Abraham realized that if God demanded this, He could also raise Isaac to life again if necessary to affect the promises. God keeps his promises. There on that distant mountain top, God stopped Abraham an instant before the act was accomplished and provided for the father and the son, a ram to be presented as the needed offering.

We don't present such offerings any more. Christ became that for us, is the Christian belief. The Heavenly Father making the same sacrifice of his own Son. Christians like Zabeth and Paul offer themselves as a daily living sacrifice so they can honour God by their living. That's commendable isn't it? Clearly Zabeth and Paul draw strength from the application of this ancient text to their own present hardship - knowing that God can supply what their children need and what they themselves need right now, and ultimately redeem this situation and give them back their family. God has given them you and other advocates, and a sympathetic lawyer and other supportive resource people, and medical professionals, and His own deep abiding presence.
